CMA FEST CONTEST RULES

Dates and Location:

This contest is scheduled to take place on May 10th, 2024 – June 1st, 2024 via a text promotion for Teabird Hard Tea. This promotion is subject to all federal, state, and local laws and regulations, and is void where prohibited by law.

Who May Enter: Contest is open to legal residents of the fifty (50) United States and District of Columbia, who are aged 21 or older as of 05.01.2024, except the following classes of persons who are not eligible to enter:

·       Employees, officers, and directors of Spirited Brands LLC, their respective affiliated companies, subsidiaries, distributors, dealers, retailers, printers, advertising, and promotion agencies, any and all other companies associated with this contest, and the members of the immediate families or households of any of the above.

How to Play:

All eligible contestants have the opportunity to text the code word to XXXX to enter to win a prize from the Premiere Prize Package.

1.     Texting the code words CMA Fest to 866.551.1361 serves as acceptance and compliance of the terms above.

2.    Limit one (1) entry per person.

Finalist Selection & Notification:  A randomly selected phone numb er will win the respective prize from the Premiere Prize package. Winners will be notified June 2nd 2024 via text.

All other costs related to prize delivery and acceptance is the responsibility of winner including but not limited to all federal state and local taxes. All properly claimed prizes will be awarded.  Prizes are non-transferable and no cash redemption or prize substitution allowed.

Failure to collect or properly claim any prize in accordance with these rules will result in forfeiture of the prize. If forfeited for any reason, contestant will not receive any other prize substitution or compensation.

Additional Rules & Restrictions:  By participating in this promotion, entrants agree to abide by and be bound by the Official Rules and the decisions of the judges, which shall be final in all matters relating to this promotion.  If winner is found in violation of these rules he/she may be required to forfeit his/her prize.  Acceptance of a prize constitutes permission for the sponsor and its agencies to use winner’s name and/or likeness for purposes of advertising and trade worldwide without limitation or further compensation, unless prohibited by law.  By accepting prizes, winners agree to hold sponsor, its affiliates, subsidiaries, advertising and promotion agencies, the promotion administrator and each of their respective directors, officers, employees and assigns harmless from and against any and all claims, damages and liability of any kind arising from or in connection with the acceptance, possession or use/misuse of any prize, or participation in the promotion or in any prize-related activities, and assume all liability therefore. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the sweepstakes or in the announcement of the prizes. 

 DISPUTES:  Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Texas State Court; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorney’s fees; and (iii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.  CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS REGARDING THESE LIMITATIONS.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligation of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.

Odds:  The odds of being selected as an official contestant(s) are dependent upon the number of entries received.
